01Agreement to these terms
By accessing https://growthnexa.com you agree to these terms. If you do not agree with them, please do not use the site.
These terms cover use of the website itself. Paid engagements are governed by a separate signed proposal or statement of work, which takes precedence wherever the two differ.
02Our services
GrowthNexa Digital provides SEO, performance marketing, social media marketing, content marketing, web design and development, and local search services. The exact scope, deliverables, timelines and fees for any engagement are set out in writing before work begins.
03No guarantee of results
Digital marketing outcomes depend on factors outside any agency's control — search engine algorithms, advertising platform policies, competitor activity, market conditions and your own product, pricing and sales process.
We forecast honestly, report transparently and will tell you early when something is not working. We do not, and cannot, guarantee specific rankings, traffic volumes, lead counts or revenue figures. Any figures shown on this site are illustrative or drawn from past engagements and are not a promise of future performance.
04Your responsibilities
- Provide timely access to the accounts, assets and people we need to do the work.
- Ensure that material you supply is accurate and that you hold the rights to it.
- Review and approve deliverables within the agreed turnaround windows.
- Settle invoices in line with the payment terms in your statement of work.
05Fees, invoicing and cancellation
Retainers are invoiced monthly in advance unless agreed otherwise. Project work is invoiced against milestones. Advertising media spend is billed by the platform directly to you and is separate from our management fee.
Either party may end a retainer with 30 days' written notice. Work already delivered and media already committed remains payable. On termination we hand over documentation, credentials and assets within 10 working days.
06Intellectual property
On full payment, all deliverables created specifically for you — content, creative, code, documentation and reports — become your property.
We retain ownership of our pre-existing frameworks, internal tooling, templates and methodologies, and of the content on this website. Nothing on this site may be copied or republished without written permission.
We may reference the engagement and anonymised performance data in our own marketing unless your agreement says otherwise.
07Confidentiality
Each party will keep the other's non-public business information confidential and use it only for the purpose of the engagement. This obligation survives the end of the engagement by three years.
08Third-party platforms
Our work depends on platforms we do not control, including search engines, advertising networks, hosting providers and analytics tools. We are not responsible for their outages, policy changes, account suspensions or pricing changes, though we will help you resolve issues where we reasonably can.
09Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to an engagement is limited to the fees paid to us for that engagement in the three months preceding the claim.
We are not liable for indirect, incidental or consequential losses, including lost profits, lost revenue or lost data. Nothing in these terms excludes liability that cannot lawfully be excluded.
10Governing law
These terms are governed by the laws of India, and the courts at Gurugram, Haryana have exclusive jurisdiction over any dispute. We will always try to resolve disagreements through direct discussion first.
